SUBJECT
An Ordinance amending Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri, by changing the zoning of property located at 1301 North Main Street, in the City and County of Cape Girardeau, Missouri, from M-1 to R-2.
EXECUTIVE SUMMARY
The attached ordinance rezones property at 1301 North Main Street. The applicant is requesting that the property be rezoned from M-1 (Light Manufacturing/Industrial District) to R-2 (Single-Family Urban Residential District). The City Council's public hearing on the rezoning request was held on April 3, 2023.
BACKGROUND/DISCUSSION A rezoning application has been submitted for the property at 1301 North Main Street. The applicant is requesting that the property be rezoned from M-1 (Light Manufacturing/Industrial District) to R-2 (Single-Family Urban Residential District).
The immediately surrounding properties are zoned R-2 on all sides except to the east, which is zoned M-1. This area is characterized by single-family residential and light industrial uses. The Cape Vision 2040 Comprehensive Plan’s Future Land Use Map shows the subject property as Institutional.
The attached ordinance rezones the property from M-1 to R-2. The City Council's public hearing on the rezoning request was held on April 3, 2023.
SUSTAINABILITY: ECONOMIC, ENVIRONMENTAL AND SOCIAL IMPACTS In considering a rezoning request, the Planning and Zoning Commission and the City Council must determine if the proposed zoning district is reasonable and in reasonable conformity with the existing uses and value of the immediately surrounding properties. The subject property contains a former church building with a gravel parking lot in the rear. It was recently purchased in order to convert the former church to a school, which is not permitted in the M-1 district. The property was zoned R-2 until 2021 when the owner of the property at the time requested rezoning to M-1 in order to convert the former church to self-storage units. The project never happened, and the property was sold. Given the fact that the property was zoned R-2 previously and is surrounded by R-2 zoned properties, the proposed zoning district is reasonable and in reasonable conformity with the existing uses and value of the immediately surrounding properties.
STAFF RECOMMENDATION The staff report to the Planning and Zoning Commission recommended approval of the rezoning request.
BOARD OR COMMISSION RECOMMENDATION The Planning and Zoning Commission held a public hearing at its March 8, 2023 meeting and recommended approval of the rezoning request by a vote of 9 in favor, 0 in opposition, and 0 abstaining.
PUBLIC OUTREACH The City Council's public hearing was advertised in the Southeast Missourian on March 18, 2023. In addition, a sign containing the date, time, location and subject of the Planning and Zoning Commission and City Council public hearings was posted on the property. Notices were also mailed to the adjacent property owners.
