SUBJECT
An Ordinance amending Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri, regarding R-4, Medium Density Multifamily Residential District.
EXECUTIVE SUMMARY
The attached ordinance amends the R-4, Medium Density Multifamily Residential District regulations in the Zoning Code (Chapter 30 of the City’s Code of Ordinances). A public hearing on the amendment was held on April 3, 2023.
BACKGROUND/DISCUSSION Attached is an amendment to the R-4 section of the Zoning Code (Chapter 30 of the City’s Code of Ordinances). The amendment adds boutique hotels to the list of special uses. A boutique hotel is defined as “a small, independently owned hotel that is design-driven, upscale and unique, with character and personality.”
The amendment was prepared at the request of Tenmile Companies, which has entered into a contract with Southeast Missouri State University to purchase and convert the historic Himmelberger House at 603 North Henderson Avenue to a boutique hotel. The property is zoned R-4, which does not permit any type of hotel. Staff did not support rezoning the property to a district that permits a hotel, so the amendment was suggested as an alternative. Tenmile Companies gave a presentation on the boutique hotel proposal at the February 15, 2023 Historic Preservation Commission meeting. The residents of the Boulevard Local Historic District (in which the property is located) were invited to attend the meeting to hear the presentation and provide input. Based on the input received from the Historic Preservation Commission and the residents, staff felt there was enough support to proceed with proposing the amendment. If the amendment is approved by the City Council, then Tenmile Companies will submit a special use permit application for the boutique hotel.
The attached ordinance amends the R-4 regulations as proposed. A public hearing on the amendment was held on April 3, 2023.
STAFF RECOMMENDATION The staff report to the Planning and Zoning Commission recommended approval of the amendment.
BOARD OR COMMISSION RECOMMENDATION The Planning and Zoning Commission reviewed the amendment at its meeting on March 8, 2023 and recommended approval by a vote of 8 in favor, 0 in opposition, and 1 abstaining.
PUBLIC OUTREACH The City Council's public hearing on the amendment was advertised in the Southeast Missourian on March 18, 2023.
