SUBJECT
An Ordinance granting a special use permit to Southeast Missouri State University and Tenmile Management, LLC for the purposes of constructing, maintaining, and operating a boutique hotel at 603 North Henderson Avenue, in the City of Cape Girardeau, Missouri. 

EXECUTIVE SUMMARY

The attached ordinance grants a special use permit for a boutique hotel at 603 North Henderson Avenue.  A public hearing on the special use permit request was held on June 5, 2023.

BACKGROUND/DISCUSSION
A special use permit application has been submitted for the property at 603 North Henderson Avenue, which is zoned R-4 (Medium Density Multifamily Residential) and H (Historic Overlay).  The property is located in the Boulevard Local Historic District.  The Himmelberger House, built in 1921, is located on the property.  The applicant is proposing to convert the house to a boutique hotel containing seven guest rooms.  A special use permit is required for a boutique hotel in the R-4 district.  Refer to the application for more information about the proposed use.

The attached ordinance grants a special use permit for the proposed use.  A public hearing on the special use permit request was held on June 5, 2023.

FINANCIAL IMPACT

STAFF RECOMMENDATION
The staff reports to the Planning and Zoning Commission and the Historic Preservation Commission recommended approval of the special use permit request, subject to several conditions.

BOARD OR COMMISSION RECOMMENDATION
The Planning and Zoning Commission held a public hearing at its May 10, 2023 meeting and recommended approval of the special use permit request, subject to the staff-recommended conditions, with a vote of 8 in favor, 0 in opposition, and 0 abstaining.  The Historic Preservation Commission reviewed the special use permit request at its May 17, 2023 meeting and recommended approval of the special use permit request, subject to the staff-recommended conditions, with a vote of 6 in favor, 0 in opposition, and 0 abstaining.

PUBLIC OUTREACH
The City Council's public hearing was advertised in the Southeast Missourian on May 20, 2023.  In addition, a sign containing the date, time, location, and subject of the Planning and Zoning Commission and City Council public hearings was posted on the property.  Notices were also mailed to the adjacent property owners.
