SUBJECT
An Ordinance amending Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri, by changing the zoning of property located at 1301 and 1316 North Main Street, in the City and County of Cape Girardeau, Missouri, from R-2 to M-1.
EXECUTIVE SUMMARY
The attached ordinance rezones property at 1301 and 1316 North Main Street. The applicant is requesting that the property be rezoned from R-2 (Single-Family Urban Residential District) to M-1 (Light Manufacturing/Industrial District). The City Council's public hearing on the rezoning request was held December 6, 2021.
BACKGROUND/DISCUSSION A rezoning application has been submitted for the property at 1301 and 1316 North Main Street. The applicant is requesting that the property be rezoned from R-2 (Single-Family Urban Residential District) to M-1 (Light Manufacturing/Industrial District).
The immediately surrounding properties are zoned R-2 (Single-Family Urban Residential District) on all sides except for the southeast, which is zoned M-1 (Light Manufacturing/Industrial District). This area is characterized by residential uses, industrial uses, and open space. The Cape Vision 2040 Future Land Use Map shows the subject property as Institutional.
The City Council's public hearing on the rezoning request was held December 6, 2021.
SUSTAINABILITY: ECONOMIC, ENVIRONMENTAL AND SOCIAL IMPACTS In considering a rezoning request, both the Planning and Zoning Commission and the City Council must determine if the proposed zoning district is reasonable and in reasonable conformity with the existing uses and value of the immediately surrounding properties. The subject property contains two buildings, each with a parking lot. One of the buildings was constructed and used as a church until it was sold several months ago. The other building was constructed and used as a gymnasium and activity center for the church. These uses were permitted under the R-2 zoning of the property. The applicant would like to convert the church building to self-storage units and use the other building for storage of construction materials and equipment. The R-2 district does not permit such uses. The applicant is requesting rezoning to M-1 for three reasons. First, the buildings are suitable for the proposed uses. Second, the M-1 district permits the proposed uses by right. Third, there are several M-1 zoned properties in the area, mostly along the east side of North Water Street. The property to the southeast is also zoned M-1. For these reasons, the rezoning request is reasonable and in reasonable conformity with the existing uses and value of the immediately surrounding properties.
STAFF RECOMMENDATION The staff report to the Planning and Zoning Commission recommended approval of the rezoning request.
BOARD OR COMMISSION RECOMMENDATION The Planning and Zoning Commission held a public hearing at its meeting November 10, 2021 and recommended approval of the rezoning request by a vote of 9 in favor, 0 in opposition, and 0 abstaining.
PUBLIC OUTREACH The City Council's public hearing was advertised in the Southeast Missourian November 21, 2021. In addition, a sign containing the date, time, location and subject of the Planning and Zoning Commission and City Council public hearings was posted on the property. Notices were also mailed to the adjacent property owners.
