SUBJECT
An Ordinance amending Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri, by changing the zoning of property located at 2854 Cape LaCroix Road, in the City and County of Cape Girardeau, Missouri, from R-1 to R-4.
EXECUTIVE SUMMARY
The attached ordinance rezones property at 2854 Cape LaCroix Road. The applicant is requesting that the property be rezoned from R-1 (Single-Family Suburban Residential District) to R-4 (Medium Density Multifamily Residential District). The City Council's public hearing on the rezoning request was held on January 9, 2023.
BACKGROUND/DISCUSSION A rezoning application has been submitted for the property at 2854 Cape LaCroix Road. The applicant is requesting that the property be rezoned from R-1 (Single-Family Suburban Residential District) to R-4 (Medium Density Multifamily Residential District).
The immediately surrounding properties are zoned C-2 (Highway Commercial District) to the north, M-1 (Light Manufacturing/Industrial District) to the east and south, R-1 (Single-Family Suburban Residential District) to the southwest, and R-4 (Medium Density Multifamily Residential District) to the west. This area is characterized by multifamily residential and light industrial uses. The Cape Vision 2040 Comprehensive Plan’s Future Land Use Map shows the subject property as Light Industrial.
The attached ordinance rezones the property from R-1 to R-4. The City Council's public hearing on the rezoning request was held on January 9, 2023.
SUSTAINABILITY: ECONOMIC, ENVIRONMENTAL AND SOCIAL IMPACTS In considering a rezoning request, the Planning and Zoning Commission and the City Council must determine if the proposed zoning district is reasonable and in reasonable conformity with the existing uses and value of the immediately surrounding properties. The subject property is undeveloped and is located across the road from two multifamily residential developments (Capetown Senior Living and The Arbors at Capetown). Another multifamily development (Heartland Care & Rehabilitation Center) is located a short distance to the east. The properties directly adjacent to the subject property contain light industrial uses, but they are separated from the subject property by a heavily wooded creek. The existing residential zoning of the subject property, the proximity to existing multifamily developments, and the natural barrier separating the subject property from the adjacent light industrial uses make the proposed rezoning reasonable and in reasonable conformity with the existing uses and value of the immediately surrounding properties.
STAFF RECOMMENDATION The staff report to the Planning and Zoning Commission recommended approval of the rezoning request.
BOARD OR COMMISSION RECOMMENDATION The Planning and Zoning Commission held a public hearing at its December 14, 2022 meeting and recommended approval of the rezoning request by a vote of 6 in favor, 0 in opposition, and 0 abstaining.
PUBLIC OUTREACH The City Council's public hearing was advertised in the Southeast Missourian on December 22, 2022. In addition, a sign containing the date, time, location and subject of the Planning and Zoning Commission and City Council public hearings was posted on the property. Notices were also mailed to the adjacent property owners.
