SUBJECT
An Ordinance amending Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri, regarding Marijuana Facilities, Medical Marijuana Facilities, and Personal Cultivation of Marijuana.
EXECUTIVE SUMMARY
The attached ordinance amends the Zoning Code (Chapter 30 of the City's Code of Ordinances) to establish requirements for marijuana facilities. A public hearing on the amendment was held on January 23, 2023.
BACKGROUND/DISCUSSION On November 8, 2022, Missouri voters approved a constitutional amendment (Amendment 3) legalizing adult use of marijuana for recreational purposes and establishing requirements for marijuana facilities. Pursuant to Amendment 3, the City must amend its zoning regulations to incorporate marijuana facilities. The attached amendment expands the regulations for medical marijuana facilities to also include marijuana facilities (i.e., facilities licensed or certified for both medical and non-medical marijuana). The amendment also provides for personal cultivation of marijuana as authorized by the state laws and regulations. The attached ordinance approves the amendment. A public hearing on the amendment was held on January 23, 2023.
BOARD OR COMMISSION RECOMMENDATION The Planning and Zoning Commission reviewed the amendment at its meeting on January 11, 2023 and recommended approval by a vote of 8 in favor, 0 in opposition, and 0 abstaining.
PUBLIC OUTREACH The City Council's public hearing on the amendment was advertised in the Southeast Missourian on January 7, 2023.
